General terms and conditions of sale

The present terms and conditions of sale are concluded on the one hand by miss Marjolaine TOURNIER whose registered office is located at 6 impasse du Micocoulier, 13111 Coudoux registered with the trade and companies register under the number 897 964 722 00010 and using the Thecandidaslayer website and by any individual or legal entity wishing to make a purchase via the Thecandidaslayer website, hereinafter referred to as “the buyer”.

Article 1. Subject

These conditions of sale are intended to define the contractual relationship between miss Marjolaine TOURNIER and the buyer and the conditions applicable to any purchase made through the Thecandidaslayer website. The acquisition of a product through this website implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to placing an order. Prior to any transaction, the buyer declares, on the one hand, that the purchase of products on the Thecandidaslayer website is not directly related to his or her professional activity and is limited to strictly personal use and, on the other hand, that he or she has full legal capacity, enabling him or her to commit to these general terms and conditions of sale.

Miss Marjolaine TOURNIER reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site. As a result, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the Thecandidaslayer website of the company madame Marjolaine TOURNIER, within the limits of available stocks. madame Marjolaine TOURNIER reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but do not bind the seller. The sale of the products presented on the Thecandidaslayer website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Rates

The prices appearing on the product sheets of the internet catalogue and are prices in euros (€). Miss Marjolaine TOURNIER reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total amount of the order. A contribution to shipping costs will be invoiced to the buyer according to the weight of the items ordered.

Article 4. Order and payment terms

Before placing an order, the buyer must create an account on the Thecandidaslayer website. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile…), Will have to identify himself using this information. The company madame Marjolaine TOURNIER offers the buyer to order and pay for its products in several steps, with 2 payment solutions:

Secure payment by PayPal or credit card (via the PAYPAL system and the Stripe system):

Finally, the buyer is redirected to the PAYPAL or Stripe secure interface, where he or she can safely enter paypal account or personal credit card details. If the payment is accepted, the order is registered and the contract definitively formed. Payment by paypal account or by credit card is irrevocable. If the purchaser has an e-mail address and has entered it on the order form, Madame Marjolaine TOURNIER will send by e-mail the confirmation of the recording of their order.

Article 5. Retention of title

The company Madame Marjolaine TOURNIER retains full and complete ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Right of withdrawal

With regard to the product "The Protocol to heal your gut", the PDF booklet is downloadable and therefore consumed as soon as it is purchased, there is no possibility of returning the PDF product, and no refund is possible.

Article 7. Cancellation of naturopathic consultations

Naturopathic consultations can be cancelled by the client up to 48 hours before the appointment. A refund will be made to the credit card used for payment, or by bank transfer, within approximately 5 to 10 days after cancellation. Madame Marjolaine TOURNIER reserves the right to cancel and refund or to postpone a naturopathic consultation without prior notice.

If the customer fails to attend any of the consultations, he/she forfeits them.

Madame Marjolaine TOURNIER reserves the right to deem the customer to have failed to show up for an appointment after 10 minutes

from the appointment start time.

Article 8. Right of withdrawal for dietary supplements

In application of the provisions of article L. 221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the order to exercise his/her right of withdrawal from Marjolaine TOURNIER, without having to justify his/her reasons or pay any penalty, for the purpose of reimbursement, on condition that the Products are returned in their original packaging, bottle still sealed, complete (i.e.; accessories, instructions) and in perfect condition, allowing them to be sold again. Damaged, unsealed, soiled or incomplete Products will not be accepted for return. In the event of the purchase of a pack of several products benefiting from a discount per unit, the Customer may exercise his right of withdrawal on the complete pack within the aforementioned period of 14 days, but he may not exercise his right of withdrawal on only one or several units of this pack. Products must be returned within fourteen (14) days following notification to Marjolaine TOURNIER of the Customer's decision to cancel. Return shipping costs are at the customer's expense. This period begins at the beginning of the first hour of the first day and ends at the end of the last hour of the last day of the period. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

It is advisable to return the parcel by tracked mail, in the event that it is lost in transit. Marjolaine TOURNIER cannot be held responsible in this respect.

Exceptions

According to article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts :

- the supply of goods made to the consumer's specifications or clearly personalized;

- the supply of goods likely to deteriorate or expire rapidly;

- the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

- the supply of goods which, after delivery and by their nature, are inseparably mixed with other items;

- the supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond the control of the professional.

Refunds

In the event of non-receipt of the order, or for any reason other than force majeure or the fault of the Customer, the sale may be cancelled at the written request of the Customer, under the conditions set out in articles L. 216-2 of the French Consumer Code. The sums paid by the Customer will then be reimbursed no later than fourteen (14) days following the date of cancellation of the contract by the Customer, to the exclusion of any compensation or deduction.

In the event of unavailability of the Product ordered, the Customer who has opted for a refund will be reimbursed the sums paid within thirty (30) days of their payment at the latest.

If the right of retraction is exercised within the period specified in article 8, only the price of the Product(s) purchased and the delivery costs will be reimbursed, with the cost of returning the Product(s) remaining at the Customer's expense. The Customer will be reimbursed within fourteen (14) days of receipt of the Products by Marjolaine TOURNIER.

Reimbursement will be made according to the method of payment used by the Customer at the time of ordering.

Article 9 - Delivery terms

Delivery refers to the transfer of physical possession or control of the goods to the consumer.

Products are delivered to the address indicated by the purchaser on the order form, and the purchaser must ensure that this address is correct. Any parcel returned to the seller because of an incorrect or incomplete delivery address will be reshipped at the buyer's expense.

If the buyer is absent on the day of delivery, depending on the carrier, the deliveryman will leave a delivery notice in the letterbox, or by default, an e-mail notification will be sent to the recipient.

Deterioration of the package and its contents :

If, at the time of delivery, the original packaging is damaged, torn or open, the buyer must check the condition of the items. If they have been damaged, the buyer must refuse the parcel and note a reservation on the delivery note (parcel refused because opened or damaged).

The buyer must indicate any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged parcel, broken products, etc.) on the delivery note in the form of handwritten reservations accompanied by his/her signature.

This verification is considered to have been carried out once the purchaser, or a person authorized by the purchaser, has signed the delivery note.

The buyer must then confirm these reservations to the carrier by registered mail within two working days of receiving the item(s), and send a copy of this letter by fax or post to the seller at the address given in the site's legal notice.

If products need to be returned to the seller, a request for their return must be made to the seller within 14 days of delivery. Any claim made outside this period will not be accepted. Returns will only be accepted for products in their original condition (packaging, accessories, instructions, etc.).

Article 10. Liability

The following are expressly considered as cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

The parties will meet to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than three months, the present terms and conditions may be terminated by the injured party.

Article 12. Intellectual property rights

All elements of the Thecandidaslayer website are and remain the exclusive intellectual property of property of Mrs Marjolaine TOURNIER. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photos, logos, visuals or text.

Article 13. Personal information

Madame Marjolaine TOURNIER undertakes to preserve the confidentiality of any information provided by the purchaser, which it would be brought to transmit for the use of certain services. All information concerning the purchaser is subject to the provisions of law n° 78-17 of January 6th 1978. In the event of difficulties in the application of the present contract, the customer may, before taking any legal action, seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his choice.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company to seek an amicable solution.

The purchaser may have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute. In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. These conditions of distance selling are governed by French law. For all

disputes, the competent court will be that of Aix-en-Provence.
